Regardless of your reasons for updating firmware or flashing the system it will get your system banned from Xbox Live as it is against Xbox Live TOS to modify your system in any way.Only way you can update the system, as far as I know, is to put another Hard drive on it with the current update already installed.It will update the console, offline, as soon as you start it up.
It shouldn't do anything to the Hard Drive as it's the system itself that's banned, not the Hard Drive or user, etc.
EDIT: I mean't buy another console as in play your PC more Yeah it didn't work. But I still can't find a straightforward answer to this question.
